Training Agreement & Safety Policy
This Agreement outlines the terms for training and coaching services provided by The Puppy Care Company (“Trainer”) and the undersigned Client (“Client”).
1. Services
The Trainer provides private, semi-private, group, online, and day-training sessions as discussed and scheduled.
Sessions may take place in the Client’s home, online, or another agreed-upon location. Written training plans will be created and updated as training progresses.
2. Payment & Scheduling
Payment is due before services begin unless otherwise agreed in writing.
Packages or sessions must be used within six (6) months of purchase unless extended by the Trainer.
Cancellations require at least 48 hours’ notice. Late cancellations or missed sessions may be charged in full.
Refunds are not automatically issued once services begin but may be considered case by case for emergencies or circumstances beyond the Client’s control.
Sessions canceled by the Trainer for weather, illness, or unforeseen events will be rescheduled or credited at the Trainer’s discretion.
3. Client Responsibilities
The Client agrees to follow training plans, safety instructions, and equipment recommendations provided by the Trainer.
The Client will supervise and manage the dog responsibly to prevent injury, damage, or unsafe situations.
The Client will inform the Trainer of any changes in the dog’s health, environment, or behavior that may affect training or safety.
The Client will provide accurate access information for in-home or day-training sessions and inform the Trainer if others will be present.
The Client will disclose any known behavioral concerns, including history of aggression, bites, or reactivity.
4. Trainer’s Commitment
The Trainer uses humane, reward-based, and evidence-informed methods and will make every reasonable effort to help the Client reach their training goals.
The Trainer does not guarantee specific outcomes, as results depend on many factors beyond the Trainer’s control, including genetics, prior history, environment, and the Client’s consistency of practice.
5. Health, Safety & Liability Waiver
The Client acknowledges and agrees that participation in dog training carries inherent risks, including but not limited to injury to persons, property, or animals.
The Client voluntarily assumes all such risks, whether foreseen or unforeseen, that may occur before, during, or after any training session.
The Client is solely responsible for their dog’s behavior, health, and management at all times.
The Trainer may refuse or reschedule sessions if a dog is ill, contagious, or poses a safety risk.
The Client releases, waives, and agrees not to hold The Puppy Care Company, its owners, employees, contractors, or affiliates liable for any injury, loss, damage, or claim that may occur during or after training.
The Client agrees to indemnify, defend, and hold harmless The Puppy Care Company and its representatives from any claims, damages, costs, or expenses (including attorney’s fees) arising from participation in training sessions or related activities.
The Trainer’s liability for any claims or damages shall not exceed the lesser of the fees paid for services within the previous six (6) months or the dog’s current market value.
6. Home Access & Property Entry
For in-home or day-training services, the Client authorizes the Trainer to enter the home or property as scheduled for services.
The Client agrees to indemnify and hold harmless the Trainer from any claims of trespass, property damage, or disputes involving third parties with authorized access.
7. Dog Health
The Client confirms that, to the best of their knowledge, the dog is healthy and current on vaccinations or titers appropriate for their age and activity level.
The dog is free from contagious illness or parasites.
The dog is not in heat during training sessions (unless previously disclosed and approved).
8. Media Release
The Client grants permission for The Puppy Care Company to use photos, videos, or recordings of their dog for educational or promotional purposes unless the Client declines in writing.
9. Governing Law
This Agreement is governed by and construed in accordance with the laws of the State of California.
10. Legal Terms
Entire Agreement: This document represents the full agreement between the parties and supersedes any prior verbal or written agreements.
Modification: Any changes must be made in writing and signed or digitally acknowledged by both parties.
Severability: If any provision of this Agreement is found invalid, the remaining provisions shall remain in effect.
Counterparts & Electronic Signature: This Agreement may be executed in counterparts and signed electronically, each deemed an original.
11. AB 1901 Trainer Disclosure Acknowledgment
Client acknowledges receipt of The Puppy Care Company – California AB 1901 Trainer Disclosure Form, which includes the Trainer’s name, address, certifications, philosophy, and statements of no relevant civil judgments or convictions.
Client understands that a written training plan with goals will be provided as part of the training process.
